Affordable Housing Developments in Toms River

Recent developments in Toms River highlight the challenges municipalities may face in meeting affordable housing obligations under Round 4.

The Township’s proposed settlement, which included extensions of expiring affordable housing units, ultimately fell through prior to court approval. Property owners of the affected complexes withdrew from the plan after determining that participation was not financially viable.

As a result, the Mayor was required to seek alternative projects to replace the anticipated deed-restricted units. However, those efforts were not finalized, and the governing body did not reach agreement on a revised settlement. At this time, Toms River does not have an approved affordable housing settlement in place.

Subsequently, a builder’s remedy lawsuit has been filed.

What’s happening in Toms River is a reminder of how important it is to get this process right. Affordable housing is complex, and when plans change late in the process, it can create real challenges for a community.
